IRS Taxpayer Advocate

The Taxpayer Advocate Service is an independent organization within the IRS. Many states also have a similar office, though we will concentrate on the IRS. (Feel free to contact us with questions specific to your state.)

Think of the Taxpayer Advocate as Internal Affairs over the IRS. Taxpayer Advocate employees help taxpayers, free of charge, if they are having a difficult time resolving their issues with the IRS. The goals of the Taxpayer Advocate Service are to protect business and individual taxpayer rights, and make the system more efficient.

We often go to the Taxpayer Advocate on behalf of our clients, after we are certain that the IRS is in the wrong. We make this a last resort, as we are essentially going over the head of a revenue officer. Revenue officers do not like it, but we like it even less when our clients rights are not recognized!

Before going to the taxpayer advocate with a problem, it is best to make sure you have reasonable cause for complaint. This may be due to an error the IRS has made, a difficult Revenue Officer, or a variety of reasons. We often see people attempting to use the taxpayer advocate when they would be better served dealing openly and honestly with a revenue officer, or using other procedures available to tax payers.

But, you may be eligible for Taxpayer Advocate Service assistance if:

  • You are experiencing economic harm or significant cost (including fees for professional representation)
  • You have experienced a delay of more than 30 days to resolve your tax issue
  • You have not received a response or resolution to the problem by the date that was promised by the IRS.
